Which US States Might Legalize Online Sports Betting in 2022: Our Predictions
In 2021 a number of key states made the push to legalize online sports betting. And even though we are early into 2022, some states have been quick to join them already. Arkansas has been a hot topic in our offices for some time, and in February of this year, the state passed the legislation.
Not all states are interested in harnessing the huge tax revenue potentials of this lucrative industry though. Some have tried already and failed, whilst others are left feeling the pressure from neighboring states to make the leap.
Legalization of US Online Sports Betting
Some of you might remember when Congress passed the Professional and Amateur Sports Protection Act in 1992. This action had a hugely negative impact on sports betting, blanket banning states from allowing bets on most sports. As the internet increased in popularity to become part of our everyday lives, sports betting online became active in 1996 across state lines. Whether the law permitted it or not.
The Federal Government in 2006 soon put paid to this and passed the Unlawful Gambling Enforcement Act. Making it a criminal act to accept money from anyone taking part in illegal gambling online in the US.
Things went further and May 2018 saw the Supreme Court rule that PASPA remove every state's authority to regulate online sports betting. SCOTUS then overturned this countrywide ban, giving responsibility back to individual states.
5 States Likely to Legalize Online Sports Betting in 2022
- North Carolina
Massachusetts is almost surrounded by states with legal online sports betting, with both Connecticut and New York approving sports betting in 2021. Massachusetts was looking very close to legalization at the end of 2021.
Mississippi and North Carolina look the most likely to go live soon in 2022. Each state has already legalized retail betting, they just need to add on the online sports betting legislation.
Kentucky and Missouri still have a way to go. Kentucky is now surrounded entirely by states that have legalized sports betting. Pushing sports bettors out of the state and spending their dollars elsewhere. There are plans afoot for both states to move forwards with their planning this year.
Expected States to Move Toward Legislation
These states have all discussed the possibility of legalizing sports betting. There are slim chances for each to act on these discussions though. Minnesota looks most promising and this is due to its neighboring state of Iowa going live in 2019. Whilst Alabama, Georgia, and Kansas all had progressive action in 2021 that seems to have died on the house floors.
We all know that Texas has the potential to blow up when it comes to online sports betting. However Lt. Gov. Dan Patrick stated in 2021 that this would not be happening in 2021, we can have hope that this year things move forwards though.
Tribal Impacts on US Online Sports Betting in 2022
Florida went live with sports betting in November 2021 and in December of the same year, the Seminole Tribe pulled out due to court rulings. An appeal was launched in February 2022 by the Department of Justice though with the hope for a resolution.
Washington legalized a state mobile in 2020 which failed, with the Indian casinos passing a retail-only bill instead. Whilst Oklahoma in 2020 tried to get approval via new compacts, it is still in the discussion stages in 2022.
Sports betting developments within California have been ongoing for some years and look very promising. State tribes have successfully pushed ballots through for retail sports betting. Whilst the biggies FanDuel and DraftKings have proposed an online sports betting ballot via agreements with tribal casinos.
