Is Online Gambling Legal in Delaware?

Gambling online in Delaware was made fully regulated (and legal) in 2012. All of the online gambling, including online casino, is managed by the Delaware Lottery who work with the state's three horseracing tracks. They ultimately are responsible for issuing licenses and ensuring that gameplay is fair and follows the law.

The venues that host horse racing are also permitted to run the premises as if they were a casino. For instance, at a location, you could equally place a bet on racing as well as play table games such as poker, or play on slot machines. Similar to Pennsylvania gambling, these "racinos" are the location you're most likely to find betting activities.

Minimum Legal age to Gamble in Delaware

As a result of this very open legislation, all online gambling is legal in Delaware. Gambling age limitations in Delaware are still in place, however, just like in other states. To play with the state lottery a player must be 18 years old. To place sports or track bets, or to play casino table games, they must, however, be 21 years old. The games and items available for gambling are:

  • Online casino; (including slots, and table games)
  • Online poker; (including tournaments)
  • Sports betting;
  • Fantasy sports.

Who Regulates Casinos in Delaware?

Gambling in Delaware isn't a free-for-all - it's all carefully managed by The Division of Gaming Enforcement (DGE) which aims to keep gambling within the state to a high standard, with integrity and no illegalities.

The Delaware Division of Gaming Enforcement also ensures that all applicants who want to participate in the selling or running the Delaware lottery are legally allowed to do so.

They rigorously maintain this by running an involuntary exclusion list, where individuals who have been convicted of gambling-related crimes are not allowed to participate in any gambling (including lottery) activity in the state.

The Delaware Division of Gaming Enforcement also carries out other related activities to ensure legalities are being followed. The Applicant and Vendor background investigations which they carry out ensure that any casino employee involved is legally allowed to work in the industry.

They also work in criminal enforcement and investigation, with a task force that investigates criminal enterprises that may harm the integrity of state gambling. They lastly create actionable plans for the industry as a whole, by keeping up to date with the latest information related to gambling in the state.
